Giloba Medical Supply Company

These Terms & Conditions govern the sale and supply of products by Giloba Medical Supply Company (“Giloba,” “we,” “us,” or “our”) to customers (“customer,” “you,” or “your”). By placing an order with us, you acknowledge that you have read, understood, and agreed to these terms.

1. Products & Product Information
   We make reasonable efforts to ensure that product descriptions, specifications, images, dimensions, colours, packaging, and other information are accurate.
   Product specifications and packaging may change from time to time due to manufacturer updates, regulatory requirements, or production changes.
   Images shown on our website, catalogue, or promotional material are for reference and may vary slightly from the actual product.
   Products are supplied subject to availability.

2. Orders & Order Confirmation
   Orders are considered confirmed only after acceptance by Giloba Medical Supply Company.
   We reserve the right to accept, modify, or reject an order due to product availability, pricing errors, minimum order requirements, or other legitimate business reasons.
   Once an order has been confirmed, cancellation may be subject to our approval and applicable charges.

3. Pricing & Payment
   All prices are subject to change without prior notice unless specifically agreed in writing.
   Applicable taxes, including GST, freight, handling, or other charges may be added where applicable.
   Payment terms will be as mutually agreed between Giloba and the customer.
   For credit customers, payment must be made within the agreed credit period.
   Giloba reserves the right to suspend further supplies in case of overdue payments.

4. Delivery & Shipping
   Delivery timelines provided at the time of order are estimates and may vary due to stock availability, transportation delays, holidays, force majeure events, or circumstances beyond our reasonable control.
   The customer is responsible for providing accurate delivery details.
   Any transportation or freight charges, where applicable, will be communicated to the customer.
   Customers should inspect packages upon delivery and report visible damage or shortages promptly.

5. Returns & Replacements
   Returns or replacements are accepted only with prior approval from Giloba Medical Supply Company.
   Requests for damaged, defective, incorrect, or short-supplied products should be reported within 3 days of delivery, along with relevant photographs, invoice details, batch information, and other supporting documents where applicable.
   Products that have been opened, used, altered, damaged after delivery, improperly stored, or otherwise mishandled may not be eligible for return or replacement.
   Certain products may be non-returnable due to their nature, sterility, safety, regulatory requirements, or storage conditions.

6. Storage & Handling
   Customers are responsible for storing and handling products according to the manufacturer’s recommended conditions and applicable product instructions.
   Giloba shall not be responsible for damage or deterioration resulting from improper storage, handling, transportation after delivery, or misuse by the customer.
   Medical & Regulatory Responsibility
   Products supplied by Giloba are intended to be used for their specified and intended purposes.
   Customers are responsible for ensuring that products are used, stored, handled, and disposed of in accordance with applicable laws, regulations, professional requirements, and manufacturer instructions.
   Giloba does not provide medical diagnosis, treatment, or professional medical advice through the sale of its products.
   
   

7. Limitation of Liability
   To the maximum extent permitted by applicable law, Giloba Medical Supply Company shall not be liable for indirect, incidental, special, consequential, or business losses arising from the use, inability to use, or delay in receiving a product.
   Our liability, where legally applicable, shall generally be limited to the value of the affected product or order, subject to applicable law and the specific terms agreed with the customer.
   
   

8. Force Majeure
   Giloba shall not be considered responsible for delays or failure to fulfil an order caused by circumstances beyond our reasonable control, including natural disasters, epidemics, government restrictions, strikes, transportation disruptions, shortages of raw materials, supply-chain disruptions, fire, war, or other unforeseen events.
   
   

9. Intellectual Property
   All trademarks, logos, product images, catalogues, designs, text, graphics, and other content belonging to Giloba Medical Supply Company may not be copied, reproduced, modified, or commercially used without prior written permission, except where permitted by law.
   
   

10. Changes to Terms
    Giloba Medical Supply Company reserves the right to update or modify these Terms & Conditions from time to time. The updated version will apply to transactions made after the effective date of the revised terms.

11. Governing Law
    These Terms & Conditions shall be governed by and interpreted in accordance with the laws applicable in India. Any disputes shall be subject to the jurisdiction of the appropriate courts having jurisdiction over the company’s registered/business location, unless otherwise agreed in writing.
    
    By placing an order with Giloba Medical Supply Company, the customer acknowledges and agrees to these Terms & Conditions.
